Supported by the climate organization Germanwatch, Lliuya asserts that climate warming has accelerated the melting of the Palcaraju Glacier, which poses an increased flooding risk to his farm located in Huaraz. To mitigate these risks, Lliuya is seeking $3.5 million to fund a flood control project.
Estimates suggest that RWE is responsible for a mere fraction—less than half of one percent—of global carbon emissions, primarily stemming from coal production. In light of this, Lliuya’s lawsuit claims that RWE should contribute $18,500 towards the flood control efforts, as reported by Reuters.
Research published in 2021 confirmed that climate warming has indeed contributed to the retreat of the Palcaraju Glacier, heightening the flood risk in Huaraz. RWE maintains that no single emitter can be deemed responsible for climate change. The company stated, “If such a claim were to exist under German law, it would also be possible to hold every motorist liable.” This position underlines the complexities surrounding individual accountability in climate change.
Although the lawsuit faced initial dismissal in a court in Essen, it advanced in the regional court in Hamm.
